Seller Terms of Service

1. Introduction

These Seller Terms of Service ("Seller Terms") govern your use of the Famous Title marketplace as a seller. By creating a storefront, listing products, or connecting a Stripe account through our platform, you agree to be bound by these Seller Terms.

These Seller Terms supplement and are in addition to our general Terms and Conditions and Privacy Policy. In the event of a conflict between these Seller Terms and the general Terms and Conditions, these Seller Terms shall prevail with respect to your activities as a seller.

2. Eligibility & Account Requirements

To sell on Famous Title, you must meet the following requirements:

You must be at least 18 years of age or the age of majority in your jurisdiction.
You must have an active Famous Title Max subscription plan.
You must provide accurate and complete business information, including your legal name and contact details.
You must comply with all applicable laws and regulations in your jurisdiction.
You must successfully complete the Stripe Connect onboarding process to receive payments.

3. Acceptable Use & Prohibited Items

You may not list, sell, or offer for sale any of the following on Famous Title:

Illegal goods or services, including items that violate federal, state, or local law.
Counterfeit, replica, or unauthorized copies of branded products.
Stolen property or goods obtained through illegal means.
Weapons, ammunition, explosives, or related accessories.
Controlled substances, illegal drugs, or drug paraphernalia.
Hazardous materials, toxic substances, or recalled products.
Products that infringe upon the intellectual property rights of others.
Content that exploits, harms, or endangers minors in any way.
Items requiring specific licenses or permits that you do not hold.

Famous Title reserves the right to determine, in its sole discretion, whether any listing violates this acceptable use policy and to remove such listings without prior notice.

4. Content Moderation

Famous Title reserves the right to review, modify, or remove any content, listings, or storefront elements that violate these Seller Terms, our general Terms and Conditions, or applicable law. This includes but is not limited to:

Product listings with misleading descriptions, images, or pricing.
Content that is defamatory, obscene, or otherwise objectionable.
Any content involving the exploitation of minors.
Listings that violate third-party intellectual property rights.

We are not obligated to monitor all seller content, but we may do so at our discretion. If you believe a listing violates our policies, please report it to support@famoustitle.com.

5. Fees & Payment Terms

The following fees apply to sales made through your Famous Title storefront:

Platform fee: 2.1% + $0.20 per successful transaction. This fee is deducted automatically from each sale.
Stripe processing fee: Stripe charges its standard processing fees (currently 2.9% + $0.30 for US cards) separately. These fees are set by Stripe and may change.
Subscription fee: A Max plan subscription is required to access storefront features. Subscription fees are billed separately.

Payouts are processed by Stripe according to your Stripe account settings and schedule. Famous Title does not hold or manage seller funds directly.

6. Stripe Connected Account

To receive payments through Famous Title, you must create and maintain a Stripe Connected Account. By connecting your Stripe account, you agree to:

Stripe's Connected Account Agreement and all applicable Stripe terms.
Provide accurate and up-to-date information required by Stripe for identity verification and compliance.
Maintain your Stripe account in good standing and comply with Stripe's acceptable use policies.

Famous Title is not a payment processor. All payment processing is handled by Stripe. We are not responsible for any issues arising from your Stripe account, including holds, disputes, or account restrictions imposed by Stripe.

7. Seller Obligations

As a seller on Famous Title, you are solely responsible for:

Product accuracy: Providing truthful and accurate product descriptions, images, pricing, and availability information.
Product safety: Ensuring all products comply with applicable safety standards and regulations.
Shipping and fulfillment: Shipping products in a timely manner and providing tracking information where applicable.
Returns and refunds: Establishing and honoring a clear return and refund policy for your products.
Customer service: Responding to buyer inquiries, complaints, and disputes in a timely and professional manner.
Legal compliance: Complying with all applicable consumer protection laws, advertising regulations, and product safety requirements.

8. Tax Responsibility

Famous Title is a marketplace platform and is not the merchant of record for transactions between sellers and buyers. As a seller, you are solely responsible for:

Determining your sales tax obligations in all applicable jurisdictions.
Collecting and remitting sales tax, value-added tax (VAT), or other applicable taxes.
Filing all required tax returns and maintaining appropriate tax records.
Obtaining any necessary tax registrations or permits.

Famous Title does not collect, calculate, or remit taxes on behalf of sellers. We strongly recommend consulting with a tax professional to understand your obligations.

9. Intellectual Property

You retain all ownership rights to the content you upload to Famous Title, including product images, descriptions, and storefront customizations. By listing content on our platform, you grant Famous Title a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the marketplace.

You represent and warrant that you own or have the right to use all content you upload, and that such content does not infringe upon the intellectual property rights of any third party. If we receive a valid DMCA takedown notice regarding your content, we will respond in accordance with our DMCA Policy.

10. Data Handling & Privacy

In the course of selling on Famous Title, you may have access to buyer information such as names, email addresses, and shipping addresses. You agree to:

Use buyer data only for the purpose of fulfilling orders and providing customer service.
Not sell, share, or distribute buyer personal information to third parties.
Protect buyer data with reasonable security measures.
Comply with all applicable data protection laws, including CCPA and GDPR where applicable.
Not send unsolicited marketing communications to buyers without their explicit consent.

11. Liability & Disclaimers

The Famous Title marketplace is provided on an "as is" and "as available" basis. We make no warranties or guarantees regarding:

The volume of sales or revenue you may generate through the platform.
Uninterrupted or error-free operation of the marketplace.
The accuracy or reliability of any marketplace features or tools.

You assume all risk and liability for your products, including product defects, personal injury, property damage, or any other claims arising from the products you sell. Famous Title shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the marketplace.

12. Indemnification

You agree to indemnify, defend, and hold harmless Famous Title, LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

The products or services you sell through the marketplace.
Your violation of these Seller Terms or any applicable law.
Any intellectual property infringement claims related to your content or products.
Tax disputes or liabilities arising from your sales.
Buyer complaints, disputes, or claims related to your transactions.
Your misuse of buyer data or violation of privacy laws.

13. Account Suspension & Termination

Famous Title reserves the right to suspend or terminate your seller account at any time, with or without notice, for any reason, including but not limited to:

Violation of these Seller Terms or our general Terms and Conditions.
Listing prohibited or illegal items.
Repeated buyer complaints or disputes.
Fraudulent or deceptive practices.
Failure to fulfill orders or provide adequate customer service.
Non-compliance with Stripe's terms or loss of Stripe account access.

You may voluntarily disconnect your Stripe account and cease selling at any time through your account settings. Upon termination, you remain responsible for fulfilling any pending orders and resolving any outstanding disputes.

14. Dispute Resolution

In the event of a dispute between you and Famous Title regarding these Seller Terms, we encourage you to first contact us at support@famoustitle.com to attempt to resolve the matter informally.

These Seller Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Seller Terms shall be brought exclusively in the federal or state courts located in Collin County, Texas.

15. Changes & Contact Information

We may update these Seller Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the marketplace after the effective date constitutes acceptance of the updated terms.
