DMCA Policy

1. Introduction

Famous Title, LLC ("Famous Title," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform.

If you believe that content hosted on Famous Title infringes your copyright, please follow the procedures outlined below to submit a takedown notice.

3. Filing a Takedown Notice

To file a DMCA takedown notice, please send a written communication to our designated agent that includes the following information, as required by 17 U.S.C. § 512(c)(3):

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and that you want removed or access to which you want disabled, including the URL or other specific location on our platform where the material can be found.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include the following:

  1. Identification of the removed material: A description of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed.
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Famous Title may be found), and that you will accept service of process from the person who provided the original takedown notification.
  4. Your contact information: Your name, address, telephone number, and email address.
  5. Signature: Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the party who filed the original takedown notice. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we will restore the removed material.

5. Repeat Infringer Policy

Famous Title has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith Requirements

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
